Expenses for integration helpers for the individual care of a pupil, through which the participation in lessons in the general school, the special school or the school for the sick is made possible, do not count towards those raised by the state of North Rhine-Westphalia or by the school authority School costs, because it is not a compulsory task to enable the assistant staff to attend school (see Section 92, Paragraph 1, Clause 2 of the North Rhine-Westphalian School Act).

In the case of children and adolescents with (physical or mental) disabilities, it must therefore be checked in each individual case whether the costs for the necessary deployment of an integration assistant within the framework of integration assistance in accordance with the provisions of Social Code IX (Section 112, Paragraph 1, No. 1 "Help for a school education" in connection with § 99 SGB IX) is possible. Integration assistance benefits are provided to people in accordance with Section 53 Paragraphs 1 and 2 of Book Twelve and Sections 1 to 3 of the Integration Assistance Ordinance in the version applicable on December 31, 2019. The costs for the school accompaniment are borne by the locally responsible provider of integration assistance (generally the districts and urban districts), to which a corresponding application must be made. Integration assistance is granted in the general school and in the special needs school. If integration assistance is granted at school, neither the income nor the assets of the pupils or their legal guardians are taken into account in accordance with Section 138 (1) No. 4 SGB IX.

  • In the case of children and adolescents with mental disabilities (e.g. autism, ADHD), it must be checked whether it is possible to assume the costs as part of integration assistance in accordance with the provisions of Book VIII of the Social Code (Section 35a, Paragraph 1 in conjunction with Paragraph 3 of Book VIII of the Social Code) . For this group of people, a corresponding application must be submitted to the locally responsible youth welfare office.
